who you are agreeing with

These terms are between you and the person who runs Lagaluga from the Netherlands. They cover lagaluga.art and every part of it that needs an account. Creating a nerd means accepting them. If you do not accept them, you can still read the magazine — the articles need no account and never will.

You are entitled to know who that is before you agree to anything. Ask at privacy@lagaluga.art and you will be told.

what a nerd is

A nerd is an account. It gets a nickname, an optional bio, and whatever takes you leave lying around. A luga is a topic; a take is your contribution to one, and you get one take per luga, because a luga is meant to be many voices rather than one person talking to themselves.

The nickname is permanent. It becomes the address of your page and sits on every take you write, so renaming would break every link pointing at you. Choose accordingly.

You need to be 16 or older. One nerd per person. Do not hand your password to anyone, and do not use someone else's account — what happens under your nerd is treated as yours.

what is public, which is most of it

This is the part worth reading twice. When you create a nerd, the following becomes visible to anyone at all — not only other nerds, but anyone with the link, and search engines that come looking:

• your nickname, on your page at lagaluga.art/nerds/your-nickname;
• your bio, if you write one;
• every take and every luga you post, with the time you posted it;
• counts of what you have written, and when you first wrote something;
• your nickname in shared furniture like the who's online panel, the hall of fame, and the front page rail.

Your email address is never shown. It is used to sign you in and to reach you about your account, and that is all.

Being public means being copyable. Anything visible on the site can be screenshotted, quoted, archived by a third party, or indexed by a search engine. Deleting a take removes it from Lagaluga; it cannot remove it from someone else's screenshot or from an archive Lagaluga does not control. Do not post something here that you would need to be able to take back.

other nerds get to talk to you

Lagaluga is a social site, so having a nerd means being reachable by other nerds. That includes features the site offers now and ones it may add later, such as:

• replying to your takes, and posting takes on lugas you started;
• poking you, or whatever the equivalent nudge is called at the time;
• sending you messages, in a shoutbox, a guestbook, or directly to your nerd;
• linking to your page, mentioning your nickname, and following what you post.

This is the point of the site rather than a side effect of it, and you accept it when you create a nerd. If being contacted by strangers is not what you want, the honest answer is not to make a nerd. Where controls to mute, block or report exist they will be in your nerd's settings, and you can always delete your account.

how to behave

Do not post, send or link to anything that:

• harasses, threatens, stalks or incites violence against anyone;
• is hateful towards people for who they are;
• is illegal in the Netherlands, or asks someone else to do something illegal;
• is sexual content involving minors, or any sexual image of a person who did not consent;
• impersonates someone, including by taking their name as your nickname;
• publishes another person's private information without their agreement;
• is spam, advertising, or an attempt to farm attention with volume.

Do not attack the site either: no scraping it wholesale, no automating accounts, no probing it for holes, no trying to reach data that is not yours. If you find a security problem, tell privacy@lagaluga.art before telling anyone else.

This is a post truth art and fashion magazine, so writing something untrue on purpose is a genre rather than a violation. Doing it in someone else's name is not.

what you write stays yours

You keep every right you have in what you post. You are not signing anything over.

You do give Lagaluga permission to store your posts, show them on the site, and include them in the ordinary furniture around them — a front page rail, a list of recent takes, a hall of fame, a link preview when someone shares the page. That permission is free, non-exclusive, worldwide, and exists only so the site can display what you asked it to display. Delete a post and the permission goes with it, subject to the copies described in the box above.

Post only what is yours to post. If you quote or use someone else's work, that is on you.

moderation, and losing your nerd

Lagaluga is small and moderated by hand, which means slowly and imperfectly. A post that breaks the rules above can be removed, and a nerd that keeps breaking them can be suspended or deleted. Something illegal, or something that puts a person at risk, is removed as soon as it is seen and without warning.

If your nerd is removed you will be told why at the address on the account, and you can reply and argue about it — write to privacy@lagaluga.art. If you think something on the site breaks these rules, report it to the same address.

You can leave whenever you like. Deleting your nerd deletes the lugas and takes attached to it in the same operation, as described in the Privacy Policy.

what is promised, which is not much

Lagaluga is free and run by one person. It is provided as it is. Nothing here promises that the site will be available, that a feature will keep existing, that your posts are backed up, or that you will be able to get them out again. Things will break and pages will change.

Liability for loss arising from using the site is limited to what Dutch law allows to be limited. That limit does not apply to damage caused intentionally or by gross negligence, to death or personal injury, or to anything else the law says cannot be excluded — and if you are a consumer, nothing here removes a right your national law gives you.

Passwords cannot be recovered yet. If you lose yours, the account is gone and there is no reset to fall back on. Store it somewhere safe. This is stated plainly rather than buried, because it is the most likely way you will lose your nerd.

when these terms change

They will. The date at the top moves when the text does. A change that affects what you have already agreed to will be announced on the site, and where it matters you will be asked to accept the new version before carrying on. Continuing to use the site after a minor change means accepting it.

the legal boilerplate

Dutch law governs these terms, and disputes go to the competent court in the Netherlands. If you are a consumer resident elsewhere in the EU, this does not take away the protection of the mandatory rules of the country you live in, and you may bring a claim in your own courts.

If one clause here turns out to be unenforceable, the rest still stands. These terms and the Privacy Policy are the whole agreement between you and Lagaluga.
